What is "Cruel and Unusual Punishment"?
Is housing a male axe-wielding sexual sadist, rapist serial killer in a women's prison "cruel and unusual" punishment ?
[It’s come to my attention that I actually have to add that the question refers to the women, the female prisoners forced by the state to become roommates with a male corpse-hacking sexual sadist serial killer.] Like many other people fortunate enough to not have had their “capacity to reason parasitized by a pernicious ideology disguised as righteousness,” I’ve lost friends who have. Recently, I tried to explain to a close family member why I believed gender ideology was the greatest evil of our times, and then some. “First, I care about the truth, and this is all a lie.” I listed a few of the real-life effects on women of transforming preposterous ideas into policy and law and on the children and young people destroying their healthy bodies, which brought the subject to puberty blockers. “Matt Walsh said on Joe Rogan that ‘millions’ of kids had been put on puberty blockers,” he said. ”That’s a lie. Walsh is a liar, a LIAR.”
“You probably got that from the New York Times,” I said, adding that nothing the Times reported on “trans” subjects could be trusted. After twenty years, I stopped reading the paper, because of how unashamedly their editors and reporters lie when it comes to “trans”ideology and anything “trans,” one of the most egregious cases in point being: “She killed two women. At 83 She Is Charged With Dismembering a Third.”
As you can see, I got carried away. The discussion about sloppy Joe Rogan and his producer is forthcoming.
Hallowed transfeelings of an axe-wielding sexual sadist, rapist serial killer
The “she” being one Harvey Marcelin, who had served decades in prison for two murders before being released on parole in 2019 and now stood “accused of dismembering [a 68 year old woman] and hiding her body parts” after “police found human body parts in and near [HIS] her apartment and obtained video of [HIS] her riding a motorized wheelchair with a severed human leg in the seat.”
Marcelin was sentenced to life for murdering his girlfriend in 1963, but “in 1984, Ms. 🙄 Marcelin was released from prison on lifetime parole… Less than a year later…[HE] she stabbed to death another woman [HE] she had been living with.” In 1986, he got six to 12 years in prison, but “[HE] She was released on parole in 2019…”
God forbid “The Newspaper of Record” hurt the hallowed transfeelings of a corpse-hacking sexual sadist, rapist serial killer.
To complete this discussion, I’d just written sarcastically that “New York State prison authorities must be devastated at having missed the chance to place this vulnerable transwoman into the women’s prison population,” but then I thought twice… And hail GenderJesus! Reduxx reports that in “April, 2022, Marcelin was reportedly housed in a male unit on Rikers Island, but records from NYC Department of Corrections show Marcelin is now at the Rose M. Singer Center—Rikers Island’s only female facility. His birth sex is also listed as ‘female.’”
“Cruel and Unusual Punishments Shall Not be Inflicted”
according to the Eighth Amendment to the United States Constitution. What is Cruel and Unusual?
“The Eighth Amendment’s key terms—“cruel” and “unusual—are almost entirely undefined…In my view [Benjamin Wittes]…a key to rationalizing the Eighth Amendment lies in a return to those two words [that]…suggest a two-part judicial examination: whether a challenged punishment is “cruel”–needlessly and wantonly harsh…inflicting pain or misery—and, if so, whether it is by some reasonably measurable standard “unusual” or rare.
“The court majority [has] invented a kind of surrogate test…that reflected the evolutionary quality of the Constitution’s words rather than anything fixed and durable. ‘The Amendment,’ Chief Justice Earl Warren fatefully wrote, ‘must draw its meaning from the evolving standards of decency that mark the progress of a maturing society.’”
“Who is to decide—if not the reviewing judges—how far society’s maturation has progressed?…For that matter, why does the consensus need to be legislative at all? Why not a consensus of public opinion? [“Over three-fourths of American voters (77%) agree that male sex offenders or domestic abusers should not be housed in women’s prisons, regardless of how they identify.” WoLF Poll Oct 2020).] Or elite opinion?…The court’s underlying doctrine contains barely a word that could constrain judicial discretion.
“Senseless…needless pain, suffering…degrading humiliation”
“The hallmark of cruelty…is the needless infliction of pain or suffering. Judging whether a punishment is cruel…requires an assessment of whether the suffering it entails is necessary for a legitimate government purpose or whether it is senseless. On its face, this inquiry is not complicated: A punishment reasonably tied to the goal of deterrence or disabling a criminal from further harm to society is not cruel, however unpleasant it may be. A punishment that goes beyond these goals to wanton violence, irrational harshness, gross disproportionality, or needlessly degrading humiliation can reasonably be described as cruel for constitutional purposes.
“Unusualness is harder to define. How unusual is unusual enough to bar a practice deemed cruel? Clearly, if a single outlying state is engaged in a cruel punishment, any reasonable definition of unusualness must be satisfied.”
As far as I can tell, California, Maine, Minnesota, and New Jersey* allow males to be housed in the women’s prison population. Of the 300+ “incarcerated men seeking to transfer to women’s prisons [in California], 33.8%—ONE THIRD—are registered sex offenders.”
“Since 2021, California has allowed 47 male prisoners who identify as transgender or "nonbinary," [i.e., w/court- or prison-onset “gender dysphoria”**] many of whom do not even attempt to appear female, to transfer to women's prisons…Faced with the prospect of unruly biologically male inmates, prison guards now carry stronger pepper sprays…to break up unruly behavior. Women's prisons installed condom dispensers, a tacit admission that transgender inmates are raping female inmates.”
Again, what is “cruel and unusual”?
“…punishments that are so inherently cruel or degrading that they offend our sense of justice and decency.”
“…punishment that fails to meet social decency standards–it is overly painful, torturous, degrading, or humiliating…The U.S. Supreme Court has said,“if the guards act maliciously and sadistically to punish the prisoner, then that punishment would be cruel and unusual, and would violate the Eighth Amendment.”
Is housing males in prison with women “cruel and unusual”? Is housing a body-hacking sexual sadist, rapist serial killer with imprisoned women cruel, degrading, humiliating, malicious, sadistic? What do you think?
Before I left for work back in September I managed to get my Father and brothers to finally admit then men competing in women's sports was cheating. A small victory and maybe a chink in the armor!!
"Women's prisons installed condom dispensers, a tacit admission that transgender inmates are raping female inmates.”
What the ACTUAL FUCK?! This is beyond parody!!
